There is no doubt that software patents are being abused.
Software patents IN ITSELF are abusing, not being abused. Their very existence is wrong and an abusing innovation and technology advancements.
This "alternative view" article from that page tries to say that software patents are not all that bad and that it would be fine if they were regulated properly, but the truth is that they really cannot be regulated properly and fairly.
In my humble opinion, ALL patents are abusing. But I have no hope there will be a future without patents. Not even a future without software patents. Why? Because the "GCP" (I like that TLA) are in power everywhere.
Trying to stop software patents like it is done now is a nice try, and it must be tried, but it is doomed.
Trying to restrict software patents to a less harmful model is a good idea. There is no way the GCP can do anything against that because they don't want to look like unfair GCP to Joe Average who doesn't know the difference between software and hardware. After all, they want Joe Average to buy their [d]junk[/d] products. "No software patents" will be dismissed as anti-capitalism, anti-globalism, anti-etcetera, and Joe Average will believe it.
That's why we have to inform and educate a Joe Average about the issue. Mass-lobbying, writing about it and using every possible media to convey the message is what everyone should do.
Even when the odds are not very good (if they aren't), a good fight should be fought to the last breath!
And one thing.. i am somewhat more optimistic i admit, but maybe the very fact how much harm software patents are already doing to USA industry will be the very thing to prove the facts against software patents even to the Joe Average. You don't have to be a techie nor a smart-ass to see when something is awefully wrong. And software patents are becoming a vivid example of it.
