Apparently Novell didn't

Apparently Novell didn't receive a patent license, but its users do. The result is that you shouldn't use suse for commercial GPL'd software development, because you will be in violation of the GPL.
What good is a linux distribution that no developer outside Novell and Microsoft can support?

Not much good apparently. Just wait till GPLv3 comes out and some crucial GNU projects get licensed under it.

Novell is so screwed.

The Samba team have spoken

The Samba team have spoken out against the deal: http://news.samba.org/announcements/team_to_novell/

I find this very interesting since one of the ideas behind the agreemint was so that Samba would be 'protected' from patent litegation, but seemingly Samba didn't want this 'protection' in the first place.

Interesting.. They make some good points.

If we are to be honest to the anti-software patents ideal then yes, it should be only right that we shouldn't use software patents as means towards our ends. It is actually contradictory to what Free Software stands for.

The point about this move being divisive also sounds correct. As mentioned, Novell is a beneficiary of the Free Software community, not only a worthy contributor. As such it has it still has its obligations. Latest moves put doubts to their respect towards those obligations.

Let's see where this leads.
